A Chinese court ruled that companies are not permitted to dismiss employees solely due to their replacement by artificial intelligence. The Intermediate People's Court of Hangzhou stated that a tech firm in eastern China unlawfully dismissed an employee after he refused a demotion linked to the automation of his job through AI. “The reason for dismissal does not fall under negative circumstances such as business downsizing or operational difficulties. It also does not meet the legal condition that makes the continuation of the employment contract impossible,” the court noted. Companies cannot unilaterally terminate employees or reduce salaries due to technological advancements, the court added. The employee, referred to in the case as Zhou, is a quality control specialist at a tech firm. He was responsible for verifying the accuracy of results produced by large language models. An AI system took over his role, prompting management to decide on a demotion and a 40% salary cut. Zhou refused the transfer, and the company dismissed him, citing staff reductions due to the implementation of neural networks. The case went to arbitration and then to the Chinese judicial system, which upheld the award of a compensation package. The decision is based on a precedent set by a Chinese court in December 2025, which ruled that the introduction of AI did not meet the necessary legal standards allowing a company to terminate employment contracts. Chinese companies are eager to implement AI systems as part of a national program to achieve leadership in artificial intelligence. Meanwhile, strategists of the Communist Party of China have expressed readiness to prioritize labor market stability amid slowing economic growth and high youth unemployment. Back in December, a Nobel laureate predicted a wave of unemployment due to AI in 2026.
